Puppy Contract and Guarantee
1- The term “Seller”, in this contract and guarantee, refers to Elaraia Shetland Sheepdogs, the term “Buyer” refers to the person(s) listed below in the buyer information and the term “Puppy” refers to the puppy listed below in the puppy information.
2- The Puppy mentioned in this Contract is, at the best knowledge of the Seller, in sound health at the time of Sale. If the Buyer’s veterinarian determines the Puppy’s health is in question, within seven (7) days from the date of final purchase and possession by the Buyer, the Buyer may return the Puppy in good physical condition (at Buyer’s expense), along with a veterinarian’s statement, and the Puppy will be replaced with one of equal value, as soon as possible. There are NO CASH REFUNDS, except at the discretion of the Seller.
3- Seller assumes no responsibility for medical expenses, ordinary medical situations that may arise later (i.e. tear ducts, hernia, etc,), mortality of animal, landlord disapproval, family disputes, allergies to animal, or any other problems incurred by the Buyer except as outlined above.
4- At the time of purchase, the Puppy will have been examined by Seller’s veterinarian, been wormed regularly (pyrantel pamoate/fenbendazole), administered Ivomec, at least once, for heartworm prevention, had K9 Advantix II applied for parasite prevention and been given first round of puppy vaccinations (Solo-Jec 5). But, as the Puppy now belongs to the Buyer, it is Buyer’s responsibility to continue the Puppy’s regular vaccination schedule. Some well vaccinated puppies have been known to contract the Canine Parvovirus (CPV2), so it is imperative that the Buyer keep the vaccinations up to date. This will insure the safety of the Puppy.
NOTE: SELLER REQUIRES THAT THE BUYER KEEP THE PUPPY AWAY FOR ALL OTHER ANIMALS UNTIL ALL VACCINATIONS ARE COMPLETE.
5- Seller tests all breeding animals for the breed specific genetic diseases; Collie Eye Anomaly (CEA), Degenerative Myelopathy (DM), Multi-Drug Resistance (MDR1), von Willebrand’s Type 3 (vWD3) and/or Progressive Retinal Atrophy (CNGA1 for PRA). And/or only breeds to dogs that have also been tested for these breed specific genetic diseases. If the Puppy described in this agreement has a parent that carries one or more of the gene mutations listed above, the Buyer can request the Seller to test the puppy for those specified genes before making a deposit to purchase and the cost of the predeposit tests will be the responsibility of the Seller. If the Buyer wishes to have the Puppy tested after the deposit has been paid, the cost of the tests will be the responsibility of the Buyer. If the Buyer chooses not to purchase the puppy based on the test results taken after the deposit has been made the Seller is not obligated to refund the Buyer any and all monies paid towards the purchase of the Puppy.
6- Seller also provides a complimentary AKC microchip with the Puppy. It is at the Buyer’s discretion, responsibility and expense (if applicable) to have the Puppy microchipped.
7- ALL PUPPIES ARE SOLD AS PET QUALITY. Also there is no guarantee of the Puppy’s final size (height and/or weight) at maturity. Even though we do have a general idea, because of past breedings history, nature can (and sometimes does) have it’s own way. Puppies should be within an estimated size.
8- All Puppies are sold as pets with AKC Limited Registration, unless otherwise stated and agreed upon by Seller, below. If Puppies are sold with Full Registration/Breeder's Rights, Buyer agrees to pay any additional fees specified by the Seller.
9- If at any time, the Buyer finds they can no longer keep the Puppy/dog, Seller will gladly take it back, at the Buyer’s expense. Signed AKC papers and all veterinarian records must accompany the Puppy/dog when being returned. If, and/or when, the Puppy/dog is rehomed and any monies are received for such rehoming, any/all monies received for the purchase of the Puppy/dog will be sent to the original Buyer. Our Shelties are very precious to us and we never want them to end up in a shelter.
10- A deposit of five hundred dollars ($500.00) is required to hold a Puppy for a later final purchase date. Puppies on hold with a deposit must be picked up by a specified date, or the deposit is forfeit. All deposits are non-refundable.
11- Any changes on these conditions are subject to the approval of the Seller.
12- By sending the deposit, and/or paying the purchase price, to purchase this Puppy the Buyer is agreeing to any and all conditions of this Puppy Contract.
